1. INTRODUCTION
1.1 These Conditions apply to any purchase made with Panache Packaging. Your agreement with us includes these Terms and Conditions (“Conditions”).
1.2 Panache Jewellery Displays LTD, trading as ‘Panache Packaging’. The consumer, the person who purchases goods from The Company; Product(s), any goods arranged in the contract to be supplied to the Buyer by the Company.
1.3 No variation of these Terms and Conditions shall apply unless confirmed in writing by or on behalf of the Director of Panache Packaging. These Terms and Conditions are subject to change at the discretion of Panache Jewellery Displays LTD.
1.4 Marketing materials issued or published are used for the sole purpose of giving an approximate idea of products. Such marketing materials do not and will not form part of the contract.
2. CONSUMER RIGHTS
2.1 Return policies which are incorporated into the Conditions.
2.2 To cancel a contact, you must inform Panache Packaging within the Cancellation Period, within 7 days of delivery. You must also return any related Product(s) to us immediately, in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
3. PAYMENT
3.1 50% Deposit Payment for the product(s) is due on placing the order. The remaining 50% payment is due before delivery. Failure to make payment shall entitle Panache Packaging to refuse delivery and/or cancel any contract between the buyer and the company. For the purpose of this condition only, the final due date shall be the date of the delivery or such date as Panache Packaging has communicated to the buyer whether in writing or orally that it has the product(s) in stock.
3.2 No payment shall be considered to have been received until Panache Jewellery Displays LTD has received cleared funds.
3.3 All payments payable to Panache Packaging under the contract shall become due immediately upon termination of contract despite any other provisions.
3.4 By paying deposit the buyer agrees to the Terms and Conditions of Panache Packaging, which outline that the full balance is due before delivery.
3.5 On arrival at our independent hauler, the buyer will have one week before storage fees occur. Storage fees are charged by our hauler, and are subject to change depending on the volume and/or size of the Order.
3.6 The consumer will be made aware of these charges via invoice issued by Panache.
Panache will contact the customer before invoicing, in order to give them opportunity to pay immediately.
4. TAX
4.1 Panache Jewellery displays LTD reserves the right to charge the amount of any taxes including VAT which are payable which are included on the invoice.
5. LEGAL RIGHTS
5.1 This contract shall be governed by and interpreted in accordance with the Republic of Ireland and United Kingdom Governing Laws and submit to the exclusive jurisdiction of the English courts.
5.2 All information provided by you will be treated by Panache Jewellery Displays LTD securely and strictly in accordance with the Data protection Act 1998.
5.3 The Contracts (Right of Third Parties) Act 1999 is explicitly excluded from the contract.
6. LIABILITY
6.1 Subject to condition Panache Packaging shall not be liable for any loss of profit, loss of business, loss of goodwill, reputation, savings or revenues or any indirect or significant loss of damage, costs, expenses or other claims of compensation which arise out of or in connection with the supply of products for use or resale by the consumer.
6.2 The Consumer acknowledges and agrees in this condition Panache Packaging shall not be under any liability caused directly or indirectly in connection with this agreement.
6.3 The Consumer acknowledges and agrees the assigned risk contained in this contract is reflected in the price agreed by Panache Packaging and the buyer.
7. GENERAL
7.1 The company reserves the right to accept or refuse any order and cancel any incomplete contract with the consumer or to suspend delivery under any contact is the buyer fails to comply with any of these Conditions.
7.2 Panache Packaging create made to order products. For this reason there are no cancellations on orders once the first 50% deposit has be made.
7.3 Panache Packaging reserves the right to defer the date of delivery if it is prevented from or delayed in performance of any of Panache Packaging’s obligations in relation to the product(s) due to circumstances beyond their control including, without limitation; restraints or delays affecting the carrier or inability or delay in obtaining supplies or suitable materials. Panache Packaging shall not be liable to the Consumer.
7.4 Each right or remedy of Panache Jewellery Displays LTD under any contract of these Conditions is without prejudice to any other ride or remedy of the company.
7.5 Any claim for damage or non-delivery with not be entertained by Panache Jewellery Displays LTD unless they are notified in writing within 14 days of the arranged delivery date and are noted as damaged on the delivery note by the customer.
8. MATERIAL
8.1 Panache Packaging make every effort to supply materials in accordance with the quality of samples submitted or quoted for, the contract is not a contract of sale by sample.
9. PRINTING
9.1 It is the buyer’s responsibility to ensure photography and artwork provided is in a suitable format when submitted and confirmed with an order. Panache Packaging are not liable for any faults after which the buyer confirms this order. Any additional costs or charges are covered by the customer.
10. ARTWORK
10.1 Artwork carried out by Panache Jewellery Displays LTD that has been approved by the customer shall have no liability on the company for any errors or faults not outlined by the customer.
11. TOLERANCE
Panache Packaging will make every effort to create and deliver the correct size, print colour, finish and materials ordered however, a variance of 10% may occur.
12. DELIVERY
12. Panache Packaging cannot specify the exact time of delivery, only the possible timeframe. You will be notified via email or phone call when your packaging is in the process of delivery.
13. AIR FREIGHT
13.1 Delivery costs are calculated due to weight.
13.2 This is not next day delivery. The time scale for Air Delivery is based on the production schedule.
13.3 Once the delivery reached Panache Packaging it is them dispatched via currier, TNT and/or Fastway. The buyer can check the progress via their website(s).
